WIDENER, Circuit Judge, dissenting: I respectfully dissent for two reasons, neither of which is more important than the other. First, this case involves a question of state law that has not been answered by the West Virginia courts or in any other reported decision. As a matter of procedure and prudent deferment to the state courts, I believe this court should let West Virginia courts decide
