This is an action for a declaratory judgment, arising under the will of John E. Higgins, who died on June 24, 1926, and whose will, evidently written by himself, a layman, is as follows: "June 30, 1924 I hereby will and bequeath to the State of Wyoming all of my property both personal and real.
