Captain Bishop’s fourteen year career as an officer in the Army was involuntarily terminated because of an alleged act of “moral and professional dereliction,” to wit, falsification of a test score on an application to graduate school. Because the court finds that the evidence in support of the accusation was insubstantial, plaintiff’s pending cross-motion for summary judgment is
