MOTTO, P.J., Plaintiff, Edward Dougherty, has sued defendant, CSX Transportation Inc., (CSX), pursuant to the Federal Employer’s Liability Act (FELA), 45 U.S.C. §§51-60, claiming that he was injured as a result of CSX’s negligence and/or its violation of the Federal Locomotive Inspection Act (FLIA), 49 U.S.C. §20701.
