TASHIMA, Circuit Judge, dissenting: I respectfully dissent from the majority’s holding that compensatory damages are not available under Title II of the Americans With Disabilities Act (ADA) without a showing of discriminatory intent. Maj. op. at 674-675.1 It has been established that compensatory damages are available for intentional violations of Title VI.
